{"data":{"id":"us-ky/krs-347.010","jurisdiction":"us-ky","citation":"KRS 347.010","heading":"Legislative findings on services and supports for persons with","body":"developmental disabilities -- Construction of chapter.\nThe General Assembly of the Commonwealth of Kentucky hereby finds and declares that:\n(1) A comprehensive and outcome -driven system of  services and supports provided to\npersons with developmental disabilities must be designed, coordinated, consistent,\nand monitored to meet the self -determined needs of those persons as well as to\nprotect their legal and human rights;\n(2) The current syste m of services and supports for persons with developmental\ndisabilities needs substantial improvement in order to provide an array of services\nincluding person-driven community-based services and supports;\n(3) It is necessary to require:\n(a) The identificat ion, development, provision, and evaluation of services and\nsupports for persons with developmental disabilities;\n(b) Interagency and intra -agency planning, development, implementation, and\nevaluation of services and supports that are the most community in clusive,\nresponsive to individual needs, and that assure legal and human rights for\nequal opportunity;\n(c) Establishment of an array of community -based comprehensive services and\nsupports, provided by public and private sectors, that allow persons with\ndevelopmental disabilities the right to participate in the life of the community,\nincluding residential alternatives, employment, and social and recreational\nactivities; and\n(d) Funding strategies that promote the development of community -based\nservices and supports that demonstrate:\n1. Flexibility for the person with developmental disabilities;\n2. Distribution of available funds among all interested service providers\nbased on the needs of the person with developmental disabilities; and\n3. Efficiency and accountability to the general public.\n(4) The provisions of this chapter shall be construed to protect and promote the\ncontinuing development and maintenance of physical, mental, and social skills of\npersons with developmental disabilities; and\n(5) The provisions of this chapter shall not alter requirements and responsibilities\nmandated under any state or federal act, relieve any organizational unit or\nadministrative body of its duties under those acts, or transfer among state\norganizations or admini strative bodies any responsibilities, powers, or duties\nmandated by those acts.","path":["KRS Chapter 347"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32718","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"431ccb98a048f298e5c5824393458741fdc35db5e3c69b79a29febdee6b5bd03","source_id":"us-ky","stale":false,"prev":"us-ky/krs-346.200","next":"us-ky/krs-347.020"},"notice":"GroundRules: Original legal text.
