{"data":{"id":"us-ky/krs-347.040","jurisdiction":"us-ky","citation":"KRS 347.040","heading":"Joint statewide plan to serve developmentally disabled persons.","body":"(1) The  secretaries of the Cabinet for Health and Family Services and the\nEducation and Labor Cabinet and the chief state school officer shall jointly\ndevelop and implement a statewide plan, with adequate opportunity for public\ncomment,  to serve all persons with developmental disabilities not otherwise\nentitled to and receiving the same services under another state or federal act,\nwhich will include provisions for:\n(a) Identification and prompt and adequate interdisciplinary assessment;\n(b) Case management  services; and\n(c) Services and residential alternatives as defined by this chapter in the\nleast restrictive, individually appropriate environment.\n(2) The  first plan and annual updates shall be presented to the Legislative\nResearch  Commission  which shall refer it to an appropriate committee for\nreview and comment.\n(3) The plan shall include:\n(a) The  number of institution residents on waiting lists for placement in the\ncommunity;\n(b) The number of persons outside institutions on waiting lists for placement\nin the institution;\n(c) The  number of persons for whom  no placement is made  nor services\nprovided because of a lack of community resources;\n(d) The number, type, nature, and cost of services necessary for placement\nto occur;\n(e) The status of compliance with the plan;\n(f) The  cabinets' specific efforts to increase residential and institutional\nservices and documentation of the success of these efforts; and\n(g) The  specific plans for new  efforts to enhance  the opportunities for\npersons  with developmental disabilities to move  into less restrictive\nenvironments.\n(4) The  state health plan shall be developed consistently with the plan required\nunder this chapter.","path":["KRS Chapter 347"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52480","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"20bbd14f52096ec45a64ebefcdc6e0fc5464eea64a38eed1531a77239fb2581c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-347.030","next":"us-ky/krs-347.050"},"notice":"GroundRules: Original legal text.
