{"data":{"id":"us-ky/krs-347.050","jurisdiction":"us-ky","citation":"KRS 347.050","heading":"Rules and regulations.","body":"The Cabinet for Health and Family Services and the Department of Education shall\npromulgate and implement rules and regulations for the:\n(1) Enhancement and protection of the rights of persons receiving services and active\ntreatment in both the public and private sectors under this chapter, including but not\nlimited to the right to:\n(a) Provision of services in the least restrictive, individually appropriate\nenvironment;\n(b) An individualized service plan;\n(c) Privacy and humane service;\n(d) Confidentiality, access, referral, and transfer of records;\n(e) Monitored active treatment in the least restrictive, individually appropriate\nenvironment;\n(f) Notice of rights under this chapter; and\n(g) A fair, timely, and impartial grievance procedure to resolve grieva nces\nconcerning identification and evaluation, services and active treatment,\nresidential alternatives, and the protection of the rights of persons with\ndevelopmental disabilities under this chapter.\n(2) Implementation of this chapter providing for the ord erly development of services\nand coordination among organizational units, administrative bodies, and service\nproviders to assure effective provision of services in both the public and private\nsectors to persons with developmental disabilities.","path":["KRS Chapter 347"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32722","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"61e5f4a76c85ed828933f61ae55a038ffa9a9fedc044eb26a873909ffd31807d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-347.040","next":"us-ky/krs-347.060"},"notice":"GroundRules: Original legal text.
