{"data":{"id":"us-ky/krs-349.015","jurisdiction":"us-ky","citation":"KRS 349.015","heading":"Application for permits -- Contents, distribution, and filing of plats --","body":"Notice to record owners, licensees, and permittees -- Information required to\naccompany plats or exhibits.\n(1) Before a permit may be issued by the department to drill a coalbed  methane well on\nany tract known to be underlaid with coal -bearing strata, the well operator shall\nprovide to the department a plat prepared by a licensed, professional land surveyor\nand a licensed, professional engineer showing:\n(a) The county in which the coalbed methane well drill site is located;\n(b) The name of the surface owner of the drill site tract, the acreage of the drill\nsite tract, the names of the surface owners of adjacent tracts, the names of all\ncoal interest holders from the surface to fif ty (50) feet below the deepest\npenetration of the coalbed methane well on the tract on which the well is\nproposed to be located, and the names of all oil and gas owners from the\nsurface to one hundred (100) feet below the deepest penetration of the coalbed\nmethane well on the tract on which the well is proposed to be located;\n(c) The proposed or actual location of the coalbed methane well determined by\nbearing and distance, relative to two (2) permanent points or monuments that\nappear on the applicable Unit ed States Geological Survey seven and one -half\n(7-1/2) minute topographic quadrangle map;\n(d) The location of any other existing or permitted coalbed methane well or any\noil or gas well located within one thousand five hundred (1,500) feet of the\nwell;\n(e) The outside boundary of the mineral tract from which the coalbed methane is\nto be produced if within seven hundred fifty (750) feet of the well; and\n(f) The number to be given the coalbed methane well, the earliest date for\ncommencement of drilling, the e arliest date for commencement of any\nstimulation of the coalbed methane well, and if horizontal drilling of a coalbed\nmethane well is proposed, the vertical and horizontal alignment and extent of\nthe coalbed methane well.\n(2) If the location of any coalbed  methane well proposed to be drilled, deepened, or\nreopened is known to be underlaid by a coal bearing stratum which is not within the\narea of an existing mining permit or the proposed permitted area of a pending\napplication or permit modification for a mi ne before the division, simultaneously\nwith the filing of an application for a permit, the applicant shall send, by registered\nor certified mail, a copy of the required plat to the record coal owner or owners and\nrecord coal lessee or lessees from the surf ace to fifty (50) feet below the deepest\npenetration of the coalbed methane well on the tract on which the well is proposed\nto be located.\n(3) If the coal bearing stratum is within the area of an existing mining permit or the\nproposed permitted area of a p ending application or permit modification for a mine\nbefore the division, a copy of the required plat shall also be sent by the applicant, by\nregistered or certified mail, to each mine licensee and mine permittee operating any\nstratum as designated on the current license issued by the department and at the\naddress stated thereon.\n(4) A copy of the required plat shall also be sent, by registered or certified mail,\nsimultaneously with the filing of an application for a permit, to the surface owner of\nthe drill site tract and surface owners of adjoining tracts.\n(5) If the address of any record owner is unknown to the applicant and cannot upon\ndiligent inquiry within the county be ascertained, or if there are more than five (5)\nrecord owners, then the applicant shall file with the department an affidavit that\neither condition exists, and the department may prescribe some different method of\nnotifying the record owner in lieu of sending a copy of the plat and notice of\napplication as required by this section.\n(6) The plat shall be filed and become a permanent record, subject to inspection at any\ntime by any interested person. Any executive officer, process agent, or chief\nengineer of the mine licensee or mine permittee may be considered a mine licensee\nor mine permittee for the purposes of mailing the required copy of the plat.\n(7) If a coalbed methane well is proposed to be drilled, deepened, converted, or\nreopened by an applicant who is not the owner or lessee of all of the oil and gas\ninterests, the applicant sha ll, simultaneously with the filing of the application for a\npermit, send by registered or certified mail a copy of the required plat to the record\noil and gas lessees of, to the record oil and gas lessors of, and to the operator of all\noil and gas wells pr oducing from, all formations from the surface to one hundred\n(100) feet below the deepest penetration of the coalbed methane well on the tract\nupon which the well is proposed to be located.\n(8) The operator shall promptly upon completion of either a vertic ally drilled coalbed\nmethane well located ten (10) feet or more from the location reflected on the plat\nrequired with the permit application or a horizontally drilled coalbed methane well\nfile with the department an as -drilled plat prepared by a licensed p rofessional land\nsurveyor and a licensed professional engineer reflecting the actual coalbed methane\nwell location. If the operator has completed a horizontally drilled coalbed methane\nwell, the as-drilled plat shall show its alignment and extent. The plat  shall become a\npermanent record subject to inspection at any time by any interested persons.\n(9) Each plat, or exhibit attached thereto, shall have the following information on a\nform supplied by the department:\n(a) Notice of the application for a coalbed methane well and the address where a\ncopy of the application may be obtained;\n(b) A statement that the recipient has twenty (20) days within which to file an\nobjection to the proposed coalbed methane well, its locati on, the proposed\nstimulation in the workable coalbed, or the proposed completion in the\nworkable coalbed; and\n(c) A statement that the applicant has met and conferred with, or offered to meet\nand confer with, each coal interest holder concerning the propos ed coalbed\nmethane well, its location, the proposed stimulation in the workable coalbed,\nor the proposed completion in the workable coalbed.","path":["KRS Chapter 349"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32726","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"5afb7bd891b01febcd0bb572967045a1f75d7ba8b4c408b25aefafe7f31263f6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-349.010","next":"us-ky/krs-349.020"},"notice":"GroundRules: Original legal text.
