{"data":{"id":"us-ky/krs-349.045","jurisdiction":"us-ky","citation":"KRS 349.045","heading":"Voluntary pooling agreements.","body":"(1) When two (2) or more separately owned tracts, or portions thereof, are embraced\nwithin a drilling unit, or when there are separately owned interests in all or part of\nany such drilling unit, the operators or owners of coalbed methane owning the\ninterests may pool their interests for the development and operation of the drilling\nunit by voluntary agreement. These agreements may be based on the exercise of\npooling rights or rights to establish units which are granted in any gas or oil lease,\ncoal lease, coalbed methane lease, or similar instrument.\n(2) No voluntary pooling agreement between or among coalbed methane operators or\nowners shall be held to violate the statutory or common law of the Commonwealth\nwhich prohibits monopolies or acts, arrangements, cont racts, combinations, or\nconspiracies in restraint of trade or commerce.","path":["KRS Chapter 349"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32732","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"60b30ce861c393e93b733fd8fd320a802f53902174a12fe857d3431edc08f8d9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-349.040","next":"us-ky/krs-349.050"},"notice":"GroundRules: Original legal text.
