{"data":{"id":"us-ky/krs-349.060","jurisdiction":"us-ky","citation":"KRS 349.060","heading":"Powers and duties of Coalbed Methane Well Review Board --","body":"Promulgation of administrative regulations.\n(1) The review board shall rule upon:\n(a) Objections to proposed coalbed methane wells, their locations, the proposed\nstimulation, or the proposed completion pursuant to KRS 349.020;\n(b) Appeals of permit denials arising under KRS 349.020(5);\n(c) Requests for a hearing arising under KRS 349.025(3);\n(d) Requests for pooling orders pursuant to KRS 349.080(1);\n(e) Requests for the establishment or modific ation of drilling units for coalbed\nmethane wells;\n(f) Requests for the creation or modification of field rules relating to the drilling,\ncompletion, and production of coalbed methane wells; and\n(g) Requests for the unitization of coalbed methane wells, pools, or fields.\n(2) The review board shall meet, hold conferences, and hold hearings at a time and\nplace as designated by the chairman. The chairman may call a meeting of the review\nboard at any time. A majority of the members of the review board shall con stitute a\nquorum for the transaction of any business to come before the review board. All\ndeterminations of the review board shall be by majority vote of the quorum present.\nThe commissioner, or his or her designee within the department, shall be the\nchairman of the review board. The review board shall hold a regular monthly\nmeeting. Notice of all meetings of the review board shall be given to each member\nby the chairman at least ten (10) days in advance of each meeting, unless otherwise\nagreed by the members.\n(3) The review board shall execute, carry out, administer, and enforce the provisions of\nthis chapter in the manner provided in this section.\n(4) The review board may:\n(a) Take evidence and issue orders concerning the permitting of a coalbed\nmethane well, its location, stimulation, and the completion pursuant to KRS\n349.015; issue pooling orders in accordance with KRS 349.080(1); issue\norders regarding the establishment or modification of drilling units for coalbed\nmethane wells, field rules relating to  the drilling, completion, and production\nof coalbed methane wells; and requests for the unitization of coalbed methane\nwells, pools, and fields;\n(b) Promulgate and enforce administrative regulations and rules necessary to\ngovern the practice and procedure before the review board;\n(c) Make relevant investigations of records and facilities as it deems proper in\nconnection with ruling on any objections to a proposed coalbed methane well,\nits location, the proposed stimulation, or the proposed completion; and\n(d) Issue subpoenas for the attendance and sworn testimony from witnesses and\nsubpoenas duces tecum for the production of any books, records, maps, charts,\ndiagrams, electronic data, and other pertinent documents or data in the review\nboard's own name or at the request of any party.","path":["KRS Chapter 349"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32735","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"a0a4289c45d52d13871756d309cd49c383e53ec4c44e1509d3cabed1ede45b98","source_id":"us-ky","stale":false,"prev":"us-ky/krs-349.055","next":"us-ky/krs-349.065"},"notice":"GroundRules: Original legal text.
