{"data":{"id":"us-ky/krs-349.080","jurisdiction":"us-ky","citation":"KRS 349.080","heading":"Authority of Coalbed Methane Well Review Board to issue pooling orders.","body":"(1) Whenever an applicant proposes to drill, deepen, convert, or reopen a well for\npurposes of production of coalbed methane and the ownership of the right to\nproduce coalbed methane is in dispute, the department shall refer the application to\nthe review boar d for its consideration and the issuance of appropriate pooling\norders, if any, in accordance with KRS 349.085. Upon the issuance of a pooling\norder by the review board, and if all other provisions of this chapter are complied\nwith, the department shall issue a permit to drill, deepen, convert, or reopen the well\nand require the development and operation of all pooled tracts and interests as a\nsingle leasehold estate in accordance with the pooling order.\n(2) No pooling as permitted by this section shall be ordered except:\n(a) When an application has been filed to drill, deepen, or reopen a well within\nthe distance limitations prescribed in KRS 349.075; or\n(b) A request for pooling has been made pursuant to this section or KRS 349.085.\n(3) No pooling, as permitted by this section, shall be ordered with respect to any tract or\nportion thereof upon which a well is drilled, deepened, or converted or reopened:\n(a) Unless the pooling was requested prior to the commencement of the drilling,\ndeepening, converting, or reopening of the coalbed methane well; and\n(b) Unless the request, if made by the owner of an operating interest who elects to\nparticipate in the risk and cost of the drilling, deepening, converting, or\nreopening of the coalbed methane well, is accompanie d by a bond or other\nsecurity satisfactory to and in an amount set by the review board for the\npayment of such owner's share of the cost of drilling, deepening, converting,\nor reopening the well.\n(4) Production from any well which is ordered pooled pursuan t to this section shall be\ndeemed for all purposes to have been so produced from each tract or portion thereof\nincluded in the pool in proportion to the amounts established in the pooling order.","path":["KRS Chapter 349"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32739","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"803a0ee0dcaad4f1d3a68cb8372d6b27151a1bcab23392cf5519e32e7c01e886","source_id":"us-ky","stale":false,"prev":"us-ky/krs-349.075","next":"us-ky/krs-349.085"},"notice":"GroundRules: Original legal text.
