The department shall exercise supervision over\nall mining operations in close proximity to any well. The department shall have\naccess to the records and properties of coal, oil, gas and coalbed methane operators\nwhen necessary.\n(2) The department may receive, or may file on its own motion, formal complaints that\ndrilling or mining operations are being conducted contrary to the provisions of this\nchapter or to the order of the department or review board, and shall hold\nadministrative hearings on the complaints, in accordance with KRS Chapter 13B.\nFollowing a hearing, the department shall issue a final order necessary to secure the\nproper administration of this chapter.","path":["KRS Chapter 349"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32745","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:34Z","sha256":"169782cd54cadbad7495cf1039b84df295401dd41bd9824a93e2fa3a8605ab83","source_id":"us-ky","stale":false,"prev":"us-ky/krs-349.105","next":"us-ky/krs-349.115"},"notice":"GroundRules: Original legal text.
