{"data":{"id":"us-ky/krs-349.160","jurisdiction":"us-ky","citation":"KRS 349.160","heading":"Construction and interpretation of chapter.","body":"(1) Nothing in this chapter shall be construed to preclude any coal interest holder from\nremoving support of the surface and any structure or facilities thereon and other\nstrata as such rights may exist in any severance deed or other contract.\n(2) Nothing in t his chapter is intended to or shall be construed as superseding,\nimpairing, abridging, or affecting any specific contractual rights or obligations now\nor hereafter existing between the respective owners of coal, oil, gas, or other\nminerals, or any interests therein.\n(3) Nothing in this chapter shall be construed to, or be used or interpreted to, determine\nownership.\n(4) Nothing in this chapter shall be construed to, or be used or interpreted to, apply to\nany well otherwise permitted, approved, or regulated under KRS Chapter 353\nexcept for the wells that are to be converted to or operated as coalbed methane\nwells.\n(5) Nothing in this chapter shall be construed to authorize any limitation of production\nof coalbed methane from any coalbed methane well, lease, d rilling unit, pool, field,\nor property to prevent or control economic waste or to limit production to market\ndemand.\n(6) This chapter shall be liberally construed so as to effectuate the declaration of public\npolicy set forth in KRS 349.005.\n(7) Coalbed methane wells shall not be subject to the provisions of KRS Chapter 353,\nexcept as expressly provided in this chapter.\n(8) Gathering lines associated with coalbed methane wells shall be regulated under\nKRS 353.500(2) and the regulations promulgated thereunder.","path":["KRS Chapter 349"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32755","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:35Z","sha256":"0d5c1adb4882230492107053b5e65fcad250c4d0a42524217e5860432193fdf3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-349.155","next":"us-ky/krs-35.010"},"notice":"GroundRules: Original legal text.
