{"data":{"id":"us-ky/krs-35.185","jurisdiction":"us-ky","citation":"KRS 35.185","heading":"Unlawfully influencing action of court.","body":"(1) No authority convening a general or special court -martial, nor any other\ncommanding officer, or officer serving on the staff thereof, may censure, reprimand,\nor admonish the court or any member, military judge, or counsel thereof, with\nrespect to the findi ngs or sentence adjudged by the court, or with respect to any\nother exercise of its or their functions in the conduct of the proceeding. No person\nsubject to this code may attempt to coerce or, by unauthorized means, influence the\naction of a court -martial or court of inquiry or any member thereof in reaching the\nfindings or sentence in any case, or the action of any convening, approving or\nreviewing authority with respect to their judicial acts. The foregoing provisions\nshall not apply to:\n(a) General inst ructional or informational courses in military justice, if such\ncourses are designed solely for the purpose of instructing members of a\ncommand in the substantive and procedural aspects of courts-martial; or\n(b) Statements and instructions given in open co urt by the military judge or\ncounsel.\n(2) In the preparation of an effectiveness, fitness, or efficiency report, or any other\nreport or document used in whole or in part for the purpose of determining whether\na member of the state military forces is qualif ied to be advanced in grade or in\ndetermining the assignment or transfer of a member of the state military forces or in\ndetermining whether a member of the state military forces should be retained on\nactive status, no person subject to this code may in preparing any such report:\n(a) Consider or evaluate the performance of duty of any such member as a\nmember of a court-martial or witness therein; or\n(b) Give a less favorable rating or evaluation of any counsel of the accused\nbecause of zealous representation before a court-martial.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41912","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:52Z","sha256":"9cb99150646443dd171551324d666c4fa7b5703fb718ec996c780a433d0658f0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.180","next":"us-ky/krs-35.190"},"notice":"GroundRules: Original legal text.
