{"data":{"id":"us-ky/krs-35.205","jurisdiction":"us-ky","citation":"KRS 35.205","heading":"Challenges.","body":"(1) (a) The military judge and members of a general or special court -martial may be\nchallenged by the accused or the trial counsel for cause stated to the court. The\nmilitary judge or the court shall determine the relevancy and validity of\nchallenges for cause, an d may not receive a challenge to more than one (1)\nperson at a time. Challenges by the trial counsel shall ordinarily be presented\nand decided before those by the accused are offered.\n(b) If the exercise of a challenge for cause reduces the court below the  minimum\nnumber of members required by KRS 35.075, all parties shall,\nnotwithstanding KRS 35.145, either exercise or waive any challenge for cause\nthen apparent against the remaining members of the court before additional\nmembers are detailed by the court.  However, peremptory challenges shall not\nbe exercised at that time.\n(2) (a) Each accused and trial counsel is entitled to one (1) peremptory challenge of\nmembers of the court. The military judge may not be challenged except for\ncause.\n(b) If the exercise of a peremptory challenge reduces the court below the\nminimum number of members required by KRS 35.075, the parties shall,\nnotwithstanding KRS 35.145, either exercise or waive any remaining\nperemptory challenge not previously waived against the remaining m embers\nof the court before additional members are detailed to the court.\n(c) Whenever additional members are detailed to the court, and after any\nchallenges for cause against such additional members are presented and\ndecided, each accused and the trial cou nsel are entitled to one (1) peremptory\nchallenge against members not previously subject to peremptory challenge.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41916","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:52Z","sha256":"389ae6f53f66ef2463483d9de398ef11a602632d1fb60aab49d022aeb7b80400","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.200","next":"us-ky/krs-35.210"},"notice":"GroundRules: Original legal text.
