{"data":{"id":"us-ky/krs-35.235","jurisdiction":"us-ky","citation":"KRS 35.235","heading":"Refusal to appear or testify.","body":"(1) Any person not subject to this code, who:\n(a) Has been duly subpoenaed to appear as a witness or to produce books and\nrecords before a court -martial or court of inquiry, or before any military or\ncivil officer designated to take a deposition to be read in evidence before such\na court;\n(b) Has been duly paid or tendered the fees and mileage of a witness at the rates\nallowed to witnesses attending a criminal court of the state; and\n(c) Willfully neglects or refuses to appear, or refuses to qualify as a witne ss or to\ntestify or to produce any evidence which that person may have been legally\nsubpoenaed to produce;\nmay be punished by the military court in the same manner as a criminal court of the\nstate.\n(2) The fees and mileage of witnesses shall be advanced o r paid out of the\nappropriations for the compensation of witnesses.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:52Z","sha256":"e33883aa9f3f062e2edbbd5bcf5a604c4dc67690e1cfc6089814225a5270f9ee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.230","next":"us-ky/krs-35.240"},"notice":"GroundRules: Original legal text.
