{"data":{"id":"us-ky/krs-35.289","jurisdiction":"us-ky","citation":"KRS 35.289","heading":"Sentences: reduction in enlisted grade upon approval.","body":"(1) A court -martial sentence of an enlisted member in a pay grade above E -1, as\napproved by the convening authority, shall reduce that member to pay grade E -1,\neffective on the date of that approval, when it includes:\n(a) A dishonorable or bad-conduct discharge; or\n(b) Confinement.\n(2) If the sentence of a member who is reduced in pay grade under subsection (1) of this\nsection is set aside or disapproved, or, as finally approved, does not include any\npunishment named in subsection (1)(a) or (b) of this section,  the rights and\nprivileges of which the person was deprived because of that reduction shall be\nrestored, including pay and allowances.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41936","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:52Z","sha256":"b2fde79f6552b9d115719a4f5e52ab89913ce54282823451b6b340fc20c365a3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.285","next":"us-ky/krs-35.290"},"notice":"GroundRules: Original legal text.
