{"data":{"id":"us-ky/krs-35.334","jurisdiction":"us-ky","citation":"KRS 35.334","heading":"Appellate counsel.","body":"(1) The senior force judge advocate shall detail a judge advocate as appellate\ngovernment counsel to represent the state in the review or appeal of cases specified\nin KRS 35.333 and before any federal court when requested to do so by the state\nAttorney General . Appellate government counsel must be a member in good\nstanding of the bar of the highest court of the state to which the appeal is taken.\n(2) Upon an appeal by the state, an accused has the right to be represented by detailed\nmilitary counsel before any reviewing authority and before any appellate court.\n(3) Upon the appeal by an accused, the accused has the right to be represented by\nmilitary counsel before any reviewing authority.\n(4) Upon the request of an accused entitled to be so represented, the sen ior force judge\nadvocate shall appoint a judge advocate to represent the accused in the review or\nappeal of cases specified in subsections (2) and (3) of this section.\n(5) An accused may be represented by civilian appellate counsel at no expense to the\nstate.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41948","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:52Z","sha256":"501e9a9dd25a244de091407da143388b6846dcd1cc7547a4baa0d7e6a9601270","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.333","next":"us-ky/krs-35.335"},"notice":"GroundRules: Original legal text.
