{"data":{"id":"us-ky/krs-35.702","jurisdiction":"us-ky","citation":"KRS 35.702","heading":"Making, drawing, or uttering check, draft, or order without sufficient","body":"funds.\n(1) Any person subject to this code is guilty of making, drawing, or uttering a check,\ndraft, or order without sufficient funds and shall be punished as a court -martial may\ndirect who:\n(a) For the procurement of any article or thing of value, with the intent to defraud;\nor\n(b) For the payment of any past due obligation, or for any other purpose, with\nintent to deceive;\nmakes, draws, utters, or delivers any check, draft, or order for the payment of\nmoney upon any bank or other depository, knowing at the time that the maker or\ndrawer has not or will not have sufficient funds in, or credit with, the bank or other\ndepository for the payment of that check, draft, or order in full upon its presentment.\n(2) The making, drawing, uttering, or delivering by a maker or drawer of a check, draft,\nor order, payment of which is refused by the drawee because of insufficient funds of\nthe maker or drawer in the drawee's possession or control, is prima facie evidence of\nhis or her intent to defraud or deceive and of his or her knowledge of insufficient\nfunds in, or credit with, that bank or other depository, unless the maker or drawer\npays the holder the amount due within five (5) days after rec eiving notice, orally or\nin writing, that the check, draft, or order was not paid on presentment.\n(3) In this section, \"credit\" means an arrangement or understanding, express or implied,\nwith the bank or other depository for the payment of that check, draft, or order.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42010","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:54Z","sha256":"fc527c1293f775e088c4938f525068899ed5c4698bd914e09edfc984841fad7a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.700","next":"us-ky/krs-35.705"},"notice":"GroundRules: Original legal text.
