{"data":{"id":"us-ky/krs-35.810","jurisdiction":"us-ky","citation":"KRS 35.810","heading":"Redress of injuries to property.","body":"(1) Whenever complaint is made to any commanding officer that willful damage has\nbeen done to the property of any person or that the person's property has been\nwrongfully taken by members of the state military forces, that person may, under\nsuch regulations pr escribed, convene a board to investigate the complaint. The\nboard shall consist of from one (1) to three (3) commissioned officers and, for the\npurpose of that investigation, it has power to summon witnesses and examine them\nupon oath, to receive depositio ns or other documentary evidence, and to assess the\ndamages sustained against the responsible parties. The assessment of damages made\nby the board is subject to the approval of the commanding officer, and in the\namount approved by that officer shall be cha rged against the pay of the offenders.\nThe order of such commanding officer directing charges herein authorized is\nconclusive on any disbursing officer for the payment to the injured parties of the\ndamages so assessed and approved.\n(2) If the offenders can not be ascertained, but the organization or detachment to which\nthey belong is known, charges totaling the amount of damages assessed and\napproved may be made in such proportion as may be considered just upon the\nindividual members thereof who are shown to  have been present at the scene at the\ntime the damages complained of were inflicted, as determined by the approved\nfindings of the board.","path":["KRS Chapter 35"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42033","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:54Z","sha256":"5dfea765fc677b80be61c63d6b33460f4bcd762cf73040bbc8997512543f9015","source_id":"us-ky","stale":false,"prev":"us-ky/krs-35.807","next":"us-ky/krs-35.812"},"notice":"GroundRules: Original legal text.
