{"data":{"id":"us-ky/krs-350.057","jurisdiction":"us-ky","citation":"KRS 350.057","heading":"Coal exploration operations.","body":"(1) The secretary of the Energy and Environment Cabinet shall promulgate regulations\nfor the permitting and performance of coal exploration operations which\nsubstantially disturb the natural land surface. The regulations shall include at a\nminimum provisions f or giving notice of intention to explore including a\ndescription of the area to be explored and the period of supposed exploration and\nprovisions for reclamation, as required by this chapter, of all land disturbed in the\nexploration.\n(2) Any requirements o f public access to records set forth in the Kentucky Revised\nStatutes to the contrary notwithstanding, the secretary shall order that confidential\ntrade secrets or privileged commercial or financial information in the possession of\nthe cabinet or pursuant to a coal exploration permit remain confidential.\n(3) (a) No person or operator shall remove more than twenty-five (25) tons of coal by\ncoal exploration operations without first obtaining a coal exploration permit\nfrom the cabinet.\n(b) No person or operato r conducting coal exploration operations in which more\nthan twenty-five (25) tons of coal are removed shall knowingly and willfully\nreceive, transport, sell, convey, exchange, transfer, trade, donate, deliver, or\notherwise convert to a commercial use any c oal extracted during the course of\nthe operations, except with the prior written approval of the cabinet for the\npurpose of testing or determining the properties of the coal.\n(4) All persons or operators conducting operations pursuant to this section shall  be\nsubject to the applicable provisions of KRS 350.990.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32778","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:35Z","sha256":"c11f8ecde383c3dd6ee92b34105821c0cd13191460eaad24d0eb73e605b4bda2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.055","next":"us-ky/krs-350.060"},"notice":"GroundRules: Original legal text.
