{"data":{"id":"us-ky/krs-350.068","jurisdiction":"us-ky","citation":"KRS 350.068","heading":"Cancellation of surety.","body":"A surety upon receipt of a copy of a notice of noncompliance for failure to maintain\ncontemporaneous reclamation issued to its insured, may notify the insured by certified\nmail, return receipt requested, that surety on any area disturbed after thirty (30) days from\nthe effective date of the surety's notice may be refused unless the violation is abated. A\ncopy of such notice shall be sent by certified mail, return receipt requested, to the cabinet,\nand shall become effective upon approval by the cabinet. Wit hin thirty (30) days of\nreceipt of a notice of cancellation, the cabinet shall either accept a suitable substitute\nbond for the canceled area or shall amend the permit to delete the unbonded acreage or\nshall revoke the permit for lack of a bond. Proof of the abatement shall be documented by\nnotice to the surety from the cabinet. Nothing contained herein shall be construed to\nrelieve the surety of its liability for areas disturbed within the thirty (30) day notice\nperiod.
