{"data":{"id":"us-ky/krs-350.139","jurisdiction":"us-ky","citation":"KRS 350.139","heading":"Deposit of funds to State Treasury -- Exceptions -- Amount to be","body":"transferred to fiscal courts -- Remainder for Division of Mine Permits.\n(1) All prior enactments of this General Assembly to the contrary notwithstanding, all\nfunds received by the Energy and Environment Cabinet through the payment of fees\nand civil penalties shall be deposited in the State Treasury to the credit of the\ngeneral fund, except those fees established in KRS 350.060(11) and (13),\n350.070(2) and (4), 350.135(1), and as provided in KRS 350.990(1). All funds from\nthe forfeiture of bonds shall be placed in the State Treasury in an interest -bearing\naccount and credited to a special agency account. The interest shall become a\nsupplemental fund and may be used to supplement forfeited bonds which are\ninadequate to complete the reclamation plan. Except as provided in KRS\n350.131(1), forfeited bond funds shall be expended upon the lands for which the\nbond was given. The interest may be expended upon lands other than those for\nwhich the bo nd was given. No more than twenty -five percent (25%) of the\nsupplemental fund may be expended upon any single site, unless a larger\nexpenditure is necessary to abate an imminent danger to public health or safety.\n(2) (a) Subject to the limitation in paragr aph (b) of this subsection, the Department\nfor Natural Resources shall, on or before August 1 of each year, transfer to the\nfiscal court of the county in which the permitted operation is located, an\namount equal to thirty-three and one-third percent (33-1/3%) of all funds paid\nduring the preceding fiscal year as fees for the issuance of any permit for\nsurface coal mining operations for the general purposes of that fiscal court.\n(b) The department shall calculate the amount to be transferred each year under\nthis subsection as if the fee rates in effect pursuant to this chapter on October\n1, 2009, were still in effect during the preceding fiscal year.\n(3) Except for the amount of fees paid to fiscal courts pursuant to subsection (2) of this\nsection, all permit  and acreage fees established in KRS 350.060(11) and (13),\n350.070(2) and (4), and 350.135(1) shall be held specifically for the use of the\nDivision of Mine Permits.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32804","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:35Z","sha256":"46efad77086137ee0aacadd47f7c548ea47643d8b1b0f60790a6d3a5b44c1834","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.135","next":"us-ky/krs-350.140"},"notice":"GroundRules: Original legal text.
