{"data":{"id":"us-ky/krs-350.150","jurisdiction":"us-ky","citation":"KRS 350.150","heading":"Reclamation work by cabinet -- Procedure -- Acceptance of federal and","body":"other funds -- Access to land.\n(1) In the reclamation of land affected by surface coal mining operations for which it\nhas funds available, the cabinet may avail itself of any servic es which may be\nprovided by other state agencies or by agencies of the federal government, and may\ncompensate them for the services. The cabinet may also receive any federal funds,\nstate funds, or any other funds for the reclamation of land affected by sur face coal\nmining operations. The cabinet may cause the reclamation work to be done by its\nown employees or by employees of other governmental agencies, soil conservation\ndistricts, or through contracts with qualified persons. The contracts, other than\nnegotiated contracts awarded pursuant to KRS 350.131(3), shall be awarded to the\nlowest responsible bidder upon competitive bids after reasonable advertisement.\nThe cabinet and any other agency and any contractor under a contract with the\ncabinet shall have th e right of access to the land affected to carry out the\nreclamation.\n(2) Any funds available to the cabinet and any public works program (both funds and\nservices) may be used and expended to reclaim and rehabilitate any lands that have\nbeen subjected to su rface coal mining operations that have not been reclaimed and\nrehabilitated in accordance with standards set by this chapter or administrative\nregulations thereunder and which are not covered by bond to guarantee the\nreclamation.\n(3) A person or organizati on, having qualifications acceptable to the cabinet, may post\nbond or a cash deposit, in a sum determined by the cabinet, and assume the liability\nfor carrying out the reclamation plan approved by the cabinet in areas where the\nmining operation and any nec essary grading and backfilling have been completed.\nThe cabinet shall then release the bond posted by the permittee for the area.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32809","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:35Z","sha256":"37c730fcc1c35158c1998b8b5070091e0fdc569edf383f79b85707c94486f3ee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.145","next":"us-ky/krs-350.151"},"notice":"GroundRules: Original legal text.
