{"data":{"id":"us-ky/krs-350.151","jurisdiction":"us-ky","citation":"KRS 350.151","heading":"Permanent program administrative regulations for mining and","body":"reclamation -- Bond.\n(1) The Energy and Environment Cabinet shall promulgate permanent program\nadministrative regulations for the mining and reclamation of land disturbed or\nremoved by operations resulting from or incident to underground coal mining. The\nregulations shall recognize the distinct differences between underground mining and\nstrip mining of coal, shall be promulgated pursuant to this chapter, and shall be\nenforced as provided in KR S 350.130 and 350.990. Those activities may include\nbut not be limited to the construction of new roads or the improvement or use of\nexisting roads to gain access to the site of the activities and all lands affected by\nhaulage, excavations, workings, impou ndments, dams, ventilation shafts,\nentryways, refuse banks, dumps, stockpiles, overburden piles, spoil banks, culm\nbanks, tailings, holes or depressions, repair areas, storage areas, processing areas,\nshipping areas, and other areas upon which are sited st ructures, facilities, or other\nproperty or materials on the surface, but the regulations shall not be more stringent\nthan those applied to strip mining of coal.\n(2) The permit applicant shall file with the cabinet a reclamation bond payable to the\nCommonwealth of Kentucky with surety satisfactory to the cabinet in the sum to be\ndetermined by the cabinet for each acre or fraction thereof of the area of land\naffected, with a minimum bond of ten thousand dollars ($10,000) conditioned upon\nthe faithful performa nce of the requirements set forth in this section and of the\nadministrative regulations of the cabinet. The cabinet shall forfeit the entire amount\nof the bond for the permit area or increment in the event of forfeiture. The cabinet\nshall accept, in lieu o f the surety provided in this subsection, the deposit by the\noperator of United States government securities, cash or its equivalent in a sum\nequal to the principal amount of the required bond, or a self -bond pursuant to\nadministrative regulations promulgated by the cabinet.\n(3) In order to protect the stability of the land, the cabinet shall suspend underground\nmining activities under urbanized areas, and adjacent to industrial or commercial\nbuildings, major impoundments, or permanent streams, if the cabin et finds\nimminent danger to inhabitants of the urbanized areas.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32810","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:35Z","sha256":"d9ee4c73359b84e5166e5f76ae931127f6df1ed81943d64ccd4f37dbf2fc1542","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.150","next":"us-ky/krs-350.152"},"notice":"GroundRules: Original legal text.
