{"data":{"id":"us-ky/krs-350.430","jurisdiction":"us-ky","citation":"KRS 350.430","heading":"Explosives.","body":"The permittee or operator shall:\n(1) Provide adequate advance written notice to local governments and residents who\nmight be affected by the use of such explosives by publication of the planned\nblasting schedule in a newspaper of general circulation in the locality and by\nmailing a copy of th e proposed blasting schedule to every resident living within\none-half (1/2) mile of the proposed blasting site and by providing daily notice to\nresident/occupiers in the areas prior to any blasting;\n(2) Maintain for a period of at least three (3) years and  make available for public\ninspection upon request a log detailing the location of the blasts, the pattern and\ndepth of the drill holes, the amount of explosives used per hole, and the order and\nlength of delay in the blasts;\n(3) Limit the type of explosiv es and detonating equipment, the size, the timing and\nfrequency of blasts based upon the physical conditions of the site so as to prevent\ninjury to persons, damage to public and private property outside the permit area,\nadverse impacts on any underground m ine, and change in the course, channel, or\navailability of ground or surface water outside the permit area;\n(4) Require that all blasting operations be conducted by trained and competent persons\nas certified by the Department for Natural Resources; and\n(5) Provide that upon the request of a resident or owner of a man -made dwelling or\nstructure within one -half (1/2) mile of any portion of the permitted area the\napplicant or permittee shall conduct a preblasting survey of the structures and\nsubmit the survey to the cabinet and a copy to the resident or owner making the\nrequest. The area of the survey shall be decided by the cabinet and shall include\nsuch provisions as the cabinet shall promulgate.\n(6) Penalties for violations of this section are those set forth in KRS 350.990.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32846","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:36Z","sha256":"e0beeaba0fcdaa4b538842e3a1706032b72dc1ad55574eb1a46f7d7560c806e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.425","next":"us-ky/krs-350.435"},"notice":"GroundRules: Original legal text.
