{"data":{"id":"us-ky/krs-350.521","jurisdiction":"us-ky","citation":"KRS 350.521","heading":"Forfeiture of bonds for permits covered by fund -- Use of additional","body":"moneys when bond insufficient to cover estimated reclamation cost.\n(1) Bonds for permits covered by the fund forfeited after January 1, 2014, in accordance\nwith KRS 350.130(1) shall be placed in the fund. The commission, its members,\nand employees shall not be named a party to any forfeiture action.\n(2) Whenever the bond for a permit covered by the fund is forfeited to the cabinet, and\na cost estimate prepared by the cabinet indicates  the forfeited bond is insufficient to\nreclaim the permit to the requirements of this chapter, the cabinet shall first use any\noutstanding permit -specific performance bond for reclamation on the forfeited\npermit. Any additional moneys necessary to reclaim the permit area to the standards\nof this chapter shall be withdrawn from the reclamation guaranty fund upon request\nby the cabinet to the extent that moneys exist in the fund.\n(3) Within seven (7) days following receipt of a request for payment of funds by  the\ncabinet, the executive director of the fund shall pay to the cabinet the sum\nrequested, not to exceed the estimated reclamation cost, subject to the limitations\nset forth in subsection (2) of this section.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41775","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:36Z","sha256":"b33c35682ea7bd78a6962daf6eab740586f1e2c8a8b1b021172ffc2a2d2e1f18","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.518","next":"us-ky/krs-350.550"},"notice":"GroundRules: Original legal text.
