{"data":{"id":"us-ky/krs-350.550","jurisdiction":"us-ky","citation":"KRS 350.550","heading":"Creation of Abandoned Mine Lands Program -- Reclamation fund -- Use","body":"of fund.\n(1) There is hereby created within the Commonwealth of Kentucky an Abandoned\nMine Lands Program, to be administered within the Energy and Environment\nCabinet. The secretary o f the Energy and Environment Cabinet may promulgate\nregulations necessary to implement this program. The provisions of KRS 350.150,\n350.152, 350.154, 350.156(1) and (2), 350.158, 350.161, and 350.163 shall not be\napplicable to this program.\n(2) The Finance and Administration Cabinet is hereby directed to establish a fund to be\nknown as the abandoned mine reclamation fund (hereinafter referred to as the\n\"fund\").\n(3) The fund shall consist of amounts deposited in the fund from time to time,\nincluding but not limited to:\n(a) The reclamation fees levied pursuant to Section 402 of P.L. 95 -87 and\nallocated to the Commonwealth of Kentucky;\n(b) Any income derived from or any user charge imposed on or for land reclaimed\npursuant to the Abandoned Mine Lands Program af ter the expenses of the\nprogram have been deducted;\n(c) Donations by persons, corporations, associations, governmental entities, and\nfoundations for the purposes of the Abandoned Mine Lands Program;\n(d) Interest credited to the fund pursuant to Section 401 (e) of P.L. 95 -87 and\nallocated to the Commonwealth of Kentucky; and\n(e) All other moneys as provided for consistent with this chapter.\n(4) Moneys in the fund may be used for the following purposes:\n(a) Reclamation and restoration of land and water resourc es adversely affected by\npast coal mining, including but not limited to reclamation and restoration of\nabandoned surface mine areas, abandoned coal processing areas, and\nabandoned coal refuse disposal areas; sealing and filling of abandoned deep\nmine entries and voids; planting of land adversely affected by past coal mining\nto prevent erosion and sedimentation; prevention, abatement, treatment, and\ncontrol of water pollution created by coal mine drainage, including restoration\nof stream beds, and constructi on and operation of water treatment plants;\nprevention, abatement, and control of burning coal refuse disposal areas and\nburning coal in situ; and prevention, abatement, and control of coal mine\nsubsidence;\n(b) Acquisition and filling of voids and sealing of tunnels, shafts, and entryways;\n(c) Acquisition of land as provided for in this chapter;\n(d) Restoration, reclamation, abatement, control, or prevention of adverse effects\nof coal mining which constitute an emergency as provided for in this program;\n(e) Administrative expenses of the program to accomplish the purposes of this\nprogram;\n(f) For the purposes of Section 507(c) of P.L. 95-87; and\n(g) All other necessary expenses to accomplish the purposes of this program.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32858","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:36Z","sha256":"d6aa28b623e0373dc6530a8c2e48518839f241de5303a6bc0bd419e6df97d539","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.521","next":"us-ky/krs-350.553"},"notice":"GroundRules: Original legal text.
