{"data":{"id":"us-ky/krs-350.590","jurisdiction":"us-ky","citation":"KRS 350.590","heading":"Power of cabinet to administer provisions of Abandoned Mine Lands","body":"Program.\n(1) The cabinet shall have the power and authority, if not granted it otherwise, to\nengage in any work and to do all things necessary or expedient, including\npromulgation of rules and regulations, to implement and administer the provisions\nof the Abandoned Mine Lands Program.\n(2) The cabinet shall have the power and authority to engage in cooperative projects\nunder the program with any agency of the United States, any state and their\ngovernmental agencies.\n(3) The cabinet may initiate, in addition to any ot her remedies provided for in this\nchapter, in any court of competent jurisdiction, an action in equity for an injunction\nto restrain any interference with the exercise of the right to enter or to conduct any\nwork provided in the Abandoned Mine Lands Program.\n(4) The cabinet shall have the power and authority to construct and operate facilities for\nthe control and treatment of water pollution resulting from mine drainage. The\nextent of this control and treatment may be dependent upon the ultimate use of the\nwater; provided, that the above provisions of this subsection shall not be deemed in\nany way to repeal or supersede any portion of the Federal Water Pollution Control\nAct (33 U.S.C. secs. 1151 et seq., as amended) and no control or treatment under\nthis subsection shall in any way be less than that required under the Federal Water\nPollution Control Act. The construction of facilities may include major interceptors\nand other facilities appurtenant thereto.\n(5) The cabinet may transfer funds to other appropria te state agencies, in order to carry\nout the reclamation activities authorized by the Abandoned Mine Lands Program.","path":["KRS Chapter 350"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32868","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:36Z","sha256":"0208cadda8d18459630d56a394b93302e92be2bc856906069a8fd1c36cb46a0c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-350.585","next":"us-ky/krs-350.595"},"notice":"GroundRules: Original legal text.
