{"data":{"id":"us-ky/krs-351.025","jurisdiction":"us-ky","citation":"KRS 351.025","heading":"Duties of department relating to mine safety -- Administrative regulations.","body":"The department shall:\n(1) Promulgate administrative regulations that establish comprehensive criteria for the\nimposition and enforcement of sanctions against certified and n oncertified\npersonnel and owners and part -owners of licensed premises whose intentional\nviolation of, or order to violate, mine safety laws places miners in imminent danger\nof serious injury or death. These criteria shall include but not be limited to the\nfollowing:\n(a) In the case of individuals that are certified miners, the Mine Safety Review\nCommission may revoke or suspend an individual's certification, or probate an\nindividual's certification for first offenses, and the Mine Safety Review\nCommission shall establish a maximum penalty for subsequent offenses;\n(b) In the case of individuals that are owners or part -owners of licensed premises,\nthe Mine Safety Review Commission may impose civil monetary penalties\nagainst individuals not to exceed ten thousand dollars ($10,000); and\n(c) In the case of noncertified personnel, the Mine Safety Review Commission\nmay impose civil monetary fines equivalent to the value of the wages they\nreceive for up to ten (10) working days for first offenses and the commission\nshall establish maximum penalties for subsequent offenses;\n(2) Notwithstanding KRS 351.070(15), promulgate administrative regulations that\nestablish comprehensive criteria for the Mine Safety Review Commission's\nimposition of penalties against licensed prem ises for violations of mine safety laws\nthat place miners in imminent danger of serious injury or death. These penalties\nshall include but not be limited to the revocation or suspension of the mine's\nlicense, the probation of a mine's license, or the impos ition of a penalty against the\nlicensee not to exceed the gross value of the production of the licensed premise for\nup to ten (10) working days;\n(3) Direct that an employer shall not directly or indirectly reimburse a sanctioned miner\nor mine supervisor fo r days of work lost as a result of sanctions imposed by the\nMine Safety Review Commission;\n(4) Establish procedures by which the department shall communicate with the Federal\nMine Safety and Health Administration (MSHA) concerning allegations of mine\nsafety violations against Kentucky coal operators and miners and for reports made\nto the division under KRS 351.193;\n(5) Jointly with the Mine Safety Review Commission establish a process for referring\nallegations of mine safety violations to the Mine Safety Re view Commission for\nadjudication and for the hearing of appeals from penalties imposed by the division,\nand the underlying violation, authorized under KRS 351.070(15); and\n(6) Establish procedures to distribute quarterly reports to every licensed entity\ndescribing mine fatalities, serious mine accidents, and penalties imposed on\ncertified and noncertified personnel and licensed premises and to require the report\nto be distributed to every certified working miner employed by the licensed entity,\nposted at work sites, and reviewed at regular mine safety meetings.","path":["KRS Chapter 351"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44525","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:36Z","sha256":"c98a596a2e4657821781a50002b75d2ec63a5ae03407c2495890f567669ce1fc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-351.021","next":"us-ky/krs-351.030"},"notice":"GroundRules: Original legal text.
