{"data":{"id":"us-ky/krs-351.127","jurisdiction":"us-ky","citation":"KRS 351.127","heading":"Employment of certified emergency medical technicians or mine","body":"emergency technicians required at coal mine.\n(1) Certified emergency medical technicians or mine emergency technicians shall be\nemployed at every licensed coal mine whose employees  are actively engaged in the\nextraction, production, or preparation of coal. Persons employed as mine\nemergency technicians shall be trained in a manner established in an administrative\nregulation promulgated by the department. Persons seeking certificatio n as a mine\nemergency medical technician or mine emergency technician shall be subject to the\nfollowing additional requirements:\n(a) All persons seeking certification as a mine emergency technician shall\ndemonstrate drug - and alcohol -free status in accorda nce with KRS 351.182\nand 351.183;\n(b) The drug and alcohol testing for those seeking certification as mine\nemergency technicians shall be administered prior to the examination for the\ncertification, in accordance with KRS 351.182 and 351.183; and\n(c) Certification as a mine emergency technician shall not be issued until the\nresults of the drug and alcohol testing have been obtained. Notification shall\nbe given to the person in accordance with KRS 351.184.\n(2) These emergency medical technicians or mine emer gency technicians shall be\nemployed in the following manner:\n(a) Except as otherwise provided in paragraph (b) of this subsection, for every\nshift engaged in the production of coal at a surface or underground coal\nmining operation, there shall be:\n1. One (1) emergency medical or mine emergency technician employed on\nevery shift with ten (10) or fewer miners employed on the shift; and\n2. Two (2) emergency medical or mine emergency technicians employed\non every shift with more than ten (10) but fewer than fif ty-one (51)\nminers employed on the shift; and\n(b) For underground mines only, on every shift with more than fifty (50) miners\nworking on the shift, there shall be one (1) additional emergency medical\ntechnician or mine emergency technician for each additional fifty (50) miners,\nor any portion thereof, engaged in the extraction, production, or preparation of\ncoal, and at least one (1) emergency medical or mine emergency technician\nshall be underground at all times while miners are working in the mines\nregardless of how many miners are working on the shift.\n(3) If these emergency medical technicians or mine emergency technicians are also\nemployed in other capacities at the coal mine, they shall be available for quick\nresponse to emergencies and shall have available to them at all times the equipment\nnecessary to respond to emergencies, as prescribed by the commissioner.\n(4) If the licensee selects existing employees to be trained as emergency medical\ntechnicians or mine emergency technicians, the employees selected shall be paid\ntheir regular wages during training.\n(5) Certified emergency medical technicians and mine emergency technicians shall\nreceive annual retraining in the manner established in an administrative regulation\npromulgated by the department, during which they shall receive their regular\nwages.","path":["KRS Chapter 351"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56260","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:37Z","sha256":"0aa935dd2714252713c2aa1f67f1ac70d9258e221254a84556e60d8f465b1635","source_id":"us-ky","stale":false,"prev":"us-ky/krs-351.125","next":"us-ky/krs-351.128"},"notice":"GroundRules: Original legal text.
