{"data":{"id":"us-ky/krs-351.183","jurisdiction":"us-ky","citation":"KRS 351.183","heading":"Contracts for specimen collection and laboratory testing services --","body":"Standards, procedures, and protocol -- Criteria for proof from other sources --\nAnnual publication of certified collection and testing providers.\n(1) The division may contract wi th qualified companies to provide the collection of\nsamples and administer the required drug and alcohol tests. The contract may\nprovide that the collection of samples or testing be subcontracted, except that the\ncontract shall require:\n(a) The contractor and any subcontractors to follow all standards, procedures, and\nprotocols set forth by the United States Department of Health and Human\nServices' Substance Abuse and Mental Health Services Administration\n(SAMHSA) for the collection and testing required by KRS 351.182 and this\nsection;\n(b) The contractor's or subcontractor's drug -testing protocol shall be a ten (10)\npanel test described in KRS 351.182(8) and any other test required by order of\nthe Mine Safety Review Commission; and\n(c) The contractor or the subcontractor shall provide a medical review officer\n(MRO) who shall:\n1. Possess the ability and medical training necessary to verify positive\nconfirmed test results and evaluate those results in relation to an\napplicant's medical history or other biomedical information; and\n2. Follow all procedures outlined in the SAMHSA Medical Review Officer\nManual.\n(2) The director of the Division of Mine Safety may accept proof of drug - and alcohol-\nfree status from other sources whose tests conform to the requirements set forth in\nKRS 351.182(7) and (8) and in accordance with KRS 351.182(2)(b) under the\nfollowing conditions:\n(a) An applicant shall submit a request for acceptance of his or her drug -and\nalcohol-free status to the director accompanied by pass/fail results of a drug\nand alcohol test taken within thirty (30) days prior to the request; and\n(b) The test results shall have been performed by laboratories certified in\naccordance with the National Laboratory Certification Program (NLCP) by the\nUnited States Departm ent of Health and Human Services Administration's\nSAMHSA and in accordance with subsection (1) of this section.\n(3) The division shall maintain and publish annually a list of certified specimen\ncollection services and testing laboratories from which it will accept data.","path":["KRS Chapter 351"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44539","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:37Z","sha256":"fbddafe1c553f2c6a9dbbbaa3ec52b99a58566d27139abd174495e49d1588b5d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-351.182","next":"us-ky/krs-351.184"},"notice":"GroundRules: Original legal text.
