{"data":{"id":"us-ky/krs-351.242","jurisdiction":"us-ky","citation":"KRS 351.242","heading":"Mine safety analysis program -- Responsibility and powers of mine safety","body":"specialists.\n(1) There is hereby created in the department a mine safety analysis program.\n(2) Mine safety specialists employed in the department and conducting underground or\nsurface mine safety analysis shall satisfy the applicable requirements established in\nKRS 351.090.\n(3) A primary responsibility of the mine safety specialist is to prevent mine accidents\nand fatalities by observing and evaluating the work habits of persons involved in the\ndirect production of coal and to contact, advise, and assist these persons in\ncorrecting their unsafe or potentially hazardous actions.\n(4) Each time a mine safety specialist enters a mine to perform mine safety analysis, he\nor she shall c onfer with the foreman as to the conditions of the mine and the work\npractices of the employees.\n(5) The mine safety specialist shall keep mine management, representatives of the\nemployees, and the commissioner informed about all hazardous conditions and a ll\nmatters which may improve the safety of mines.\n(6) The division shall assist the department in assessing the effectiveness of miner\ntraining programs.\n(7) The commissioner shall at his or her discretion assign mine safety specialists to all\nmines in the  state taking into consideration such factors as the history of accidents\nat the mine, experience of the workforce, physical condition of the mine, and size of\nthe mine.\n(8) The commissioner may coordinate the assignment of mine safety specialists with\nthe appropriate federal authorities to minimize duplication of accident prevention\nefforts.\n(9) The commissioner shall report annually to the General Assembly and to the\nGovernor on the effectiveness of the mine safety specialists in improving mine\nsafety.","path":["KRS Chapter 351"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44543","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:37Z","sha256":"db7b7b016b4e612cbee4a24d073fe75b3fa680aac2ffba52fb9fce9913645ffd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-351.241","next":"us-ky/krs-351.243"},"notice":"GroundRules: Original legal text.
