{"data":{"id":"us-ky/krs-351.350","jurisdiction":"us-ky","citation":"KRS 351.350","heading":"Citation for violation -- Action against violator.","body":"(1) If upon inspection an authorized representative of the commissioner finds that an\nexplosive user or seller has violated any requirement of KRS 351.315 to 351.375, a\ncitation shall be issued to the violator.  Each citation shall describe the alleged\nviolation, establish the time period permitted for correction by fixing a reasonable\ndate by which the alleged violation shall be eliminated, if applicable, and propose\nthe civil penalty to be paid.  If within fifteen (15) working days from the receipt of\nthe cit ation the explosive user or seller fails to notify the commissioner that he\nintends to contest the citation, then the citation shall be deemed a final order and not\nbe subject to review by any court or agency.\n(2) If the explosive user or seller notifies t he commissioner that he intends to challenge\na citation issued under KRS 351.315 to 351.375, then it shall be the duty of the\ndepartment or the cabinet's Office of General Counsel upon the request of the\ncommissioner, to bring an action for the recovery of  the penalties provided for\nherein.\n(3) It shall be the duty of the cabinet's Office of General Counsel, upon the request of\nthe commissioner, to bring an action for a restraining order, temporary or permanent\ninjunction against any operator or other perso n violating or threatening to violate\nany of the provisions of KRS 351.315 to 351.375.","path":["KRS Chapter 351"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47736","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:37Z","sha256":"73dd200fc89684bdec797f1e510585bf3647a9a15d104dd614fd4131a54f2ac8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-351.345","next":"us-ky/krs-351.355"},"notice":"GroundRules: Original legal text.
