{"data":{"id":"us-ky/krs-351.367","jurisdiction":"us-ky","citation":"KRS 351.367","heading":"Permit to purchase, receive, or take possession of explosives -- Procedures -","body":"- Restrictions -- Records.\n(1) No person, firm, association, or corporation shall purchase, receive, or take\npossession of explosives without first obtaining a permit from the department.\n(2) The application for a permit to purchase, receive, or take possession of explosives\nshall be on a form prescribed by the department and shall be accompanied by an\napplication fee of twenty dollars ($20). The application shall indicate the applicant's\nname, address, type of business, the location at which the explosives will be used\nand stored, and the purpose for which the explosives will be used. On those\noperations for which licensed blasters or certified shotfirers are required, their\nnames and license numbers or certification numbers shall be included on the\napplication.\n(3) Any person, firm, association, or corporation who procures a license from the\ndepartment to operate a coal or clay mine, pursuant to KRS 351.175, and who at the\ntime of application for license requests a permit to purchase, receive, or take\npossession of explosives, shall be issued a permit by the department without cost to\nthe applicant.\n(4) Permits to purchase, receive, or take possession of explosives shall be val id for a\nperiod not to exceed one (1) year from the date of issue and shall not be\ntransferable.\n(5) Permits shall be issued only to those persons, firms, associations, or corporations\nwho have proper facilities to store explosives, or to those who provide  to the\ndepartment a written plan documenting the manner in which any excess explosives\nshall be handled and returned to proper storage facilities.\n(6) Explosive materials shall not be sold, given, delivered, or transferred to any person\nnot possessing a valid permit to purchase or receive them.\n(7) Anyone who sells, gives, or distributes explosives shall maintain accurate records\nfor each sale or gift of explosives, listing the name, address, and permit number of\nthe person or company receiving the explosi ves and the quantity and types of\nexplosives received.\n(8) The commissioner may suspend a permit for a period of twenty (20) days for due\ncause; however, a permit may not be revoked until completion of a hearing, which\nshall be conducted in accordance with KRS 351.345.\n(9) Explosives which are transferred, sold, or distributed, for the purpose of resale, by a\nregistered explosive dealer or manufacturer to another registered dealer or\nmanufacturer shall be exempt from the provisions of this section.","path":["KRS Chapter 351"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32963","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:37Z","sha256":"83bb2d5e291bde72daba58429ec3448b2cece74763005547ea61e2419a993ba4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-351.365","next":"us-ky/krs-351.370"},"notice":"GroundRules: Original legal text.
