{"data":{"id":"us-ky/krs-352.110","jurisdiction":"us-ky","citation":"KRS 352.110","heading":"Mines to have two openings -- Exception -- Condemnation of land for","body":"opening.\n(1) No licensee, superintendent, mine manager, or mine foreman of any mine opened\nafter June 16, 1972, shall permit persons to work therein unless there are to every\nseam of coal worked in the mine at least two (2) separate outlets, separated by\nnatural strata of not less than one hundred fifty (150) feet in breadth if the mine is\nworked by shaft or slope, and separated by a pillar of natural strata of not less than\ntwo thousand (2,000) square feet if the mine is worked by drift, by which outlets\ndistinct means of ingress and egress are readily available to persons employed in the\nmine, but it shall not be necessary for the two (2) outlets to belong to the same\nmine. This subse ction does not apply to the openings of a new entry that is being\nworked for the purpose of making connection between the two (2) outlets so long as\nnot more than twenty (20) persons are employed at one (1) time in making the\nconnection or driving the seco nd opening, or to any mine in which the second\nopening has been rendered unavailable by reason of final robbing or removal of\npillars so long as not more than twenty (20) persons are employed therein at one (1)\ntime, and the workings are no farther than fi ve hundred (500) feet from the bottom\nof the shaft or slope or from the drift opening.\n(2) If any mine has but one (1) means of ingress or egress for persons employed therein,\nand the owner does not own suitable ground for another opening, the owner may\nselect appropriate adjacent ground for that purpose and have it condemned pursuant\nto the Eminent Domain Act of Kentucky.","path":["KRS Chapter 352"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32982","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:38Z","sha256":"12988dcf658dea831c4f80307a3e2ae6b9ff825d7900c35a70b89cb5140777f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-352.100","next":"us-ky/krs-352.120"},"notice":"GroundRules: Original legal text.
