{"data":{"id":"us-ky/krs-352.133","jurisdiction":"us-ky","citation":"KRS 352.133","heading":"Approved self -rescuer devices -- Caches of devices -- Locations --","body":"Requirements -- Felony for removal.\n(1) All underground miners shall be provided with an approved self -contained self -\nrescuer device and shall have that device within twenty -five (25) feet of them at all\ntimes. The self -contained self -rescuer shall be provided to the miners by the\nlicensee at no cost to the miners.\n(2) In addition to the requirements for self -contained self -rescuers set forth in this\nsection, all licensed premises shall  maintain caches of self -contained self -rescuer\ndevices which shall be stored in locations readily accessible to the primary and\nsecondary escapeways or provide proof of an order for self -contained self-rescuers\nthrough the submission of a valid purchase o rder that clearly names the vendor,\ncontact information for the vendor, the number of devices purchased, and the date\nof the order, which shall not be later than thirty (30) days after July 12, 2006. In all\ncases, the self-contained self-rescuers shall be in place by July 1, 2007, or shall be\nextended by the commissioner upon substantiated proof of unavailability.\n(a) The caches shall be maintained in sufficient numbers and locations\ndetermined in accordance with the most recent rules, standards, and\nregulations issued by the United States Mine Safety and Health\nAdministration and this section.\n(b) The caches shall be maintained in storage units capable of protecting the self -\ncontained self-rescuers from water, dust, and any other condition which will\ncause deterioration of the self-contained self-rescuers.\n(c) The storage unit locations shall have reflective signs that read \"SELF -\nRESCUERS\" conspicuously posted as to be visible from the primary and\nsecondary escapeways.\n(d) In addition to the requirements set  forth in this section for self -contained self-\nrescuers, the mine operator shall provide for each person who is underground\nat least one (1) additional self -contained self -rescuer device which provides\nprotection for a period of one (1) hour or longer, to cover all persons in the\nmine.\n(e) If a mantrip or mobile equipment is used to enter or exit the mine, additional\nself-contained self -rescuer devices, each of which provides protection for a\nperiod of one (1) hour or longer, shall be available for all pers ons who use the\ntransportation from portal to portal.\n(3) It shall be a Class D felony for any person to remove a self -rescuer from the cache\nfor purposes other than use during an emergency, or for repair, maintenance, or\nreplacement or as authorized by the licensee.","path":["KRS Chapter 352"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=32985","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:38Z","sha256":"0ffba002a06fd8236acf23eba4b77f2978b6d4e2d9205d3254c14df57cd15b7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-352.130","next":"us-ky/krs-352.135"},"notice":"GroundRules: Original legal text.
