{"data":{"id":"us-ky/krs-352.210","jurisdiction":"us-ky","citation":"KRS 352.210","heading":"Conduct in mine -- Intoxication, alcoholic beverage or controlled substance","body":"prohibited -- Notification to director of violations of substance - or alcohol -\nabuse policies.\n(1) No person shall knowingly injure any shaft, lamp, instrument, air course, or brattice;\nobstruct or throw open airways; disturb any part of the machinery or appliances;\nopen a door used for directing ventilation without closing it afterwards; enter any\npart of a mine against caution; disobey any order given in carrying out any of the\nprovisions of KRS Chapter 351 or 352; or do any act endangering the life or health\nof any person employed in the mine or endangering the security of the mine.\n(2) No person shall enter or be on any licensed facility while intoxicated or under the\ninfluence of alcohol or a controlled substance or be in possession of any alcoholic\nbeverage or controlled substance at any licensed facility; provided, however, this\nshall not apply to private vehicles driven to and from the mine.\n(3) The licensee shall notify  the director, by the close of the next business day, of any\ncertified persons who have been discharged for violation of the company's\nsubstance-abuse or alcohol -abuse policies or who tested positive and failed to\ncomplete an employee assistance program.","path":["KRS Chapter 352"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44550","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:38Z","sha256":"f50a239c2b2cc3b2a19fb3924dd3051e76b181a6c0175da285ec6fe586128b73","source_id":"us-ky","stale":false,"prev":"us-ky/krs-352.201","next":"us-ky/krs-352.220"},"notice":"GroundRules: Original legal text.
