{"data":{"id":"us-ky/krs-352.640","jurisdiction":"us-ky","citation":"KRS 352.640","heading":"Emergency action plans -- Components -- Copies -- Training -- Evacuation","body":"and firefighting programs.\n(1) An emergency action plan shall be submitted with each application for a license to\noperate an underground mine. The emergency action plan shall b e for use during\nemergencies at the licensed facility. The plan shall consist of the following\ncomponents:\n(a) A certification, submitted by the applicant, that the telephone or equivalent\ntwo-way communications system will be in place and functioning at t he\nfacility when operation begins;\n(b) A listing of the telephone numbers of the facility personnel, state and federal\nregulatory agencies, and state, federal, and local emergency response agencies\nto be contacted in the event of a mine emergency;\n(c) The positions and telephone numbers of the persons designated by the licensee\nto implement the emergency action plan during mine emergencies;\n(d) The name of the ambulance service or first responder with which the licensee\nhas made arrangements to provide twen ty-four (24) hour emergency medical\nassistance for any person injured at the licensed facility;\n(e) A copy of the licensed facility's mine emergency evacuation and firefighting\nplan, if one is required; and\n(f) A training schedule for all personnel as to t heir responsibilities under the\nemergency action plan. On site, each licensed facility shall maintain a log\ncontaining training dates, the personnel trained, and their positions and shifts.\n(2) The licensee shall provide a revised copy of the plan to the r egional office and the\nFrankfort office of the Division of Mine Safety within ten (10) days of a change in\nany of the information required in subsection (1) of this section becoming effective.\n(3) The licensee shall be responsible for ensuring that copies of the licensed facility's\nemergency action plan are submitted to the appropriate regional office and to the\nFrankfort office of the Division of Mine Safety. Copies of the plan also shall be\nkept on the premises of the licensed facility where it shall be m ade open to\ninspection by the licensee's employees and their independent contractors and\ninspectors.\n(4) Each licensed facility shall post in a prominent place at the mine office a copy of all\nemergency contact numbers. The list of emergency contact number s shall be made\navailable to the licensee's employees and their independent contractors during\ntraining on the emergency action plan.\n(5) Each licensed facility shall train all employees of the licensee, including their\nindependent contractors, at the begi nning of their employment with the licensed\nfacility and on an annual basis on the emergency action plan and the persons\nresponsible for the plan's implementation.\n(6) Each licensed facility on which an underground mine is operated shall develop and\nimplement a mine emergency evacuation and firefighting program that instructs all\nminers and other personnel of the licensed facility in the proper evacuation\nprocedures they must follow if a mine emergency occurs. The program, and any\nrevisions thereto, must be submitted to the director or his designee. All personnel of\nthe licensed facility, including independent contractors, shall be trained in the\nperformance of the plan's revisions prior to any of the revisions being implemented.\nThe program shall include a plan to train all miners on all shifts with procedures\nfor:\n(a) Mine emergency evacuation for mine emergencies that present an imminent\ndanger to miners due to fire, explosion, or gas, or water inundation;\n(b) Evacuation of all miners not required for a mine emergency response;\n(c) Rapid assembly and transportation of necessary miners, fire suppression\nequipment, and rescue apparatus to the scene of the mine emergency; and\n(d) Operation of fire suppression equipment available in the mine.","path":["KRS Chapter 352"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44554","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:38Z","sha256":"ca8d03cc7266f282d267e64e44c7bd1b6924c31d22fd473cbba0772fb5f20ab1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-352.630","next":"us-ky/krs-352.650"},"notice":"GroundRules: Original legal text.
