{"data":{"id":"us-ky/krs-353.010","jurisdiction":"us-ky","citation":"KRS 353.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Active mining area\" means the area within two hundred (200) feet surrounding\ncurrent mine works under development, inclusive of the area of five (5) year\nprojections, as indicated on the annually filed mine license map.\n(2) \"Barrel\" or \"barrel of oil\" means forty -two (42) standard United States liquid\nmeasure gallons of two hundred thirty -one (231) cubic inches per gallon, computed\nat a temperature of sixty (60) degrees Fahrenheit.\n(3) \"Casing\" means a string or strings of pipe commonly placed in wells drilled for\nnatural gas and petroleum.\n(4) \"Cement\" means hydraulic cement properly mixed with water only.\n(5) \"Coal operator\" means any person who proposes to or does operate a coal mine.\n(6) \"Cubic feet of gas\" means the volume of gas contained in one (1) cubic foot of\nspace at a standard pressure base of fourteen and seventy -three hundredths (14.73)\npounds per square inch and a temperature base of sixty (60) degrees Fahrenheit.\n(7) \"Department\" means the Department for Natural Resources.\n(8) \"Directional survey\" means a survey performed while drilling using continuous\nmeasuring technology, a survey made through drilling tools, or other surveys at such\nintervals to accurately determine the location of the deviated wellbore.\n(9) \"Gas\" means natural gas.\n(10) \"Gas well\" means any well which:\n(a) Produces natural gas not associated or blended with crude petroleum oil any\ntime during production; or\n(b) Produces more than ten thousand (10,000) cubi c feet of natural gas to each\nbarrel of crude petroleum oil from the same producing horizon.\n(11) \"Inclination survey\" means a survey performed to measure deviation from the true\nvertical, irrespective of direction, expressed in degrees.\n(12) \"NAD 83\" means the North American Datum, 1983 version, using feet units.\n(13) \"Oil\" means petroleum.\n(14) \"Oil well\" means any well which produces one (1) barrel or more of oil to each ten\nthousand (10,000) cubic feet of natural gas.\n(15) \"Plat\" means a map, drawing, or print showing the location of a well.\n(16) \"Single Zone Projection\" means the Kentucky Single Zone State Plane Coordinate\nSystem of 1983, based on Lambert Conformal Conic map projection with double\nstandard parallels on the North American Datum, 1983 version, as established in 10\nKAR 5:010.\n(17) \"True vertical\" means the orientation of the well at ninety degrees (90°) from the\nhorizontal plane at the surface elevation.\n(18) \"Unit\" means any tract or tracts which the department has determined is underlaid\nby a pool or pools of oil and associated gas, and is not a \"drilling unit\" as defined in\nKRS 353.510(19).\n(19) \"Well\" means a borehole drilled or proposed to be drilled for the purpose of\nproducing natural gas or petroleum, or one through whic h natural gas or petroleum\nis being produced.\n(20) \"Well operator\" means any person who proposes to or does locate, drill, operate, or\nabandon any well.\n(21) \"Workable bed\" means:\n(a) A coal bed actually being operated commercially;\n(b) A coal bed that the  department decides can be operated commercially and the\noperation of which can reasonably be expected to commence within not more\nthan ten (10) years; or\n(c) Any coal bed that, from outcrop indication or other definite evidence, proves\nto the satisfaction  of the department to be workable and, when operated, will\nrequire protection if wells are drilled through it.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33050","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:38Z","sha256":"73dfd697f585a67f1d2a3bcdda39cf89bfd604cf0a0d4b25714dbf27cd0b7a95","source_id":"us-ky","stale":false,"prev":"us-ky/krs-352.9901","next":"us-ky/krs-353.020"},"notice":"GroundRules: Original legal text.
