{"data":{"id":"us-ky/krs-353.060","jurisdiction":"us-ky","citation":"KRS 353.060","heading":"Petition to object to location of well -- Notice -- Hearing -- Drilling permit.","body":"(1) If the drilling of a well on any tract underlaid with coal -bearing strata will endanger\nthe present or future use or operation of a workable coal bed, the owner  or coal\noperator affected may, within fifteen (15) days from the receipt of the plat by him\nand by the department, file with the Energy and Environment Cabinet's Office of\nAdministrative Hearings a petition in accordance with KRS 353.700 and any\nadministrative regulations promulgated thereunder, listing the specific objections in\nwriting to the proposed location. The Energy and Environment Cabinet's Office of\nAdministrative Hearings shall provide notice of receipt of the petition to the well\noperator and t he department, and shall schedule a hearing, at which the objections\nshall be considered.\n(2) (a) At the hearing, the well operator and the coal operator or owner, in person or\nby a representative, shall consider the objections and either agree upon the\nlocation as proposed or change it so as to satisfy all objections and meet the\napproval of the department.\n(b) Any new location thus selected and agreed upon shall be indicated on a plat in\naccordance with KRS 353.050 and thereupon the department shall issue  to the\nwell operator a drilling permit approving the location and authorizing the well\noperator to drill at the location.\n(c) If the coal operator and well operator, or the owner and well operator, are\nunable to agree, the hearing officer shall make a rec ommendation to the\nsecretary, in view of the purposes and intent of this chapter and in compliance\ntherewith, to fix a location on the tract as near the proposed location as\npossible and upon final order of the secretary, the department shall issue to the\nwell operator a permit to drill at the new location.\n(3) If no objections are filed within the fifteen (15) day period, the department shall\nimmediately issue to the well operator a drilling permit approving the location and\nauthorizing the well operator to proceed to drill there.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47756","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:38Z","sha256":"5f95f8f6702126e765a3f420bae3a6068b88d745b34f9b56ab16e92ef135b01c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.050","next":"us-ky/krs-353.070"},"notice":"GroundRules: Original legal text.
