The department shall  exercise supervision over all mining\noperations in close proximity to any well. The department shall have access to the\nrecords and properties of coal and oil and gas operators when necessary.\n(2) The department may receive, or may file on its own motion, formal complaints with\nthe Energy and Environment Cabinet's Office of Administrative Hearings that\ndrilling or mining operations are being conducted contrary to the provisions of KRS\n353.010, 353.050 to 353.130, 352.510, or 353.592, or to an order of the department.\nFollowing a hearing, the secretary shall issue a final order necessary to secure the\nproper administration of KRS 353.010, 353.050 to 353.130, 352.510, or 353.592.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47757","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"214c7d497027018fdf35ea6a531334b1933b51457724a079a53c6ad2de1fe390","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.190","next":"us-ky/krs-353.205"},"notice":"GroundRules: Original legal text.
