{"data":{"id":"us-ky/krs-353.415","jurisdiction":"us-ky","citation":"KRS 353.415","heading":"Carbon dioxide sequestration facility permit requirements -- Application","body":"of KRS 353.411 to 353.459.\n(1) A person shall not construct or operate a carbon dioxide sequestration facility\nwithout first securing a:\n(a) Class VI underground injecti on control permit from the US EPA or the\ncabinet; and\n(b) Drilling permit issued by the cabinet.\n(2) The injection of carbon dioxide for purposes of enhancing the recovery of oil or\nnatural gas pursuant to a permit approved by the cabinet under KRS 353.592  shall\nnot be subject to the provisions of KRS 353.411 to 353.459.\n(3) If an oil, natural gas, or coalbed methane well operator proposes to convert its\noperations to carbon dioxide sequestration, then the underground carbon dioxide\nsequestration facility shall be regulated pursuant to KRS 353.411 to 353.459.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57860","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"c4c0ffd83746bf8f95364bf3c00a0873f2939228cc8a4832511eff3e45b95cba","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.413","next":"us-ky/krs-353.417"},"notice":"GroundRules: Original legal text.
