{"data":{"id":"us-ky/krs-353.419","jurisdiction":"us-ky","citation":"KRS 353.419","heading":"Application notice requirements.","body":"(1) Public notice of an application for a Class VI well permit under KRS 353.411 to\n353.459 shall allow at least thirty (30) days for public comment.\n(2) The cabinet shall send the public notice to the applicant, who shall be responsible\nfor publication of the  notice pursuant to KRS Chapter 424 within thirty (30) days\nprior to the submission of an application. Upon publication, the applicant shall send\nthe cabinet a copy of the certificate of publication. The cost of publication shall be\nborne by the applicant.\n(3) Notice of an application for a Class VI well permit shall be served on each mineral\nlessee, mineral owner, and pore space owner with a legal interest in the property or\nproperties that involves the sequestration reservoir, and adjoining surface and\nmineral owners of record.\n(4) Service of individual notices required by this section shall be through personal\nservice, by registered mail, or by any method of delivery that requires a receipt or\nsignature confirmation.\n(5) Service of any unknown or missing owners shall be deemed to have occurred,\nprovided that the sequestration operator has complied with this section and KRS\n353.449.\n(6) The cabinet may hold a public hearing at its discretion if a hearing may assist in\nclarifying one (1) or more issues invol ved in the Class VI well permit decision.
