{"data":{"id":"us-ky/krs-353.421","jurisdiction":"us-ky","citation":"KRS 353.421","heading":"Technical review of applications -- Duties of cabinet.","body":"(1) Within sixty (60) calendar days of receiving an application for a Class VI\nunderground injection control well, the cabinet shall provide written notice to the\napplicant as to the administrative completeness of the application. If the application\nis determined to be administratively:\n(a) Complete, the cabinet shall notify the applicant in writing that the technical\nreview period provided by subsection (2) of this section has begun; or\n(b) Incomplete, the cabinet shall notify the applicant of the deficiencies  that\nrender it administratively incomplete. The applicant shall have thirty (30)\ncalendar days from receiving the cabinet's notice of deficiency to correct the\ndeficiencies and render the application administratively complete.\n(2) (a) Technical review of an application shall begin when the cabinet has deemed\nthe application administratively complete and ready for review. The cabinet\nshall issue a final determination to either approve or deny the application\nwithin three hundred sixty -five (365) calendar da ys from the date an\nadministrative completeness determination has been made by the cabinet.\n(b) If the application is found deficient during technical review, the cabinet shall\nnotify the applicant in writing of the deficiencies identified by the cabinet\nduring the review. The applicant shall respond to the deficiencies with\ninformation that addresses the identified deficiencies.\n(3) An application shall be considered temporarily withdrawn when an applicant is\ncorrecting deficiencies noted by the cabinet pu rsuant to subsection (1)(b) or (2)(b)\nof this section. Periods of temporary withdrawal shall not be counted against the\nreview period allotted to the cabinet for administrative or technical review.
