{"data":{"id":"us-ky/krs-353.437","jurisdiction":"us-ky","citation":"KRS 353.437","heading":"Carbon dioxide sequestration facility administrative fund.","body":"(1) There is hereby created in the State Treasury an interest -bearing, restricted, agency\naccount to be known as the carbon dioxide sequestration facility administrative\nfund. All amounts required to be deposited into the fund shall not be segregated into\nseparate accounts but may be used by the cabinet as provided in this section for any\ncarbon dioxide sequestration project. Notwithstanding KRS 45.229, any balance\nremaining in the fun d at the end of any fiscal year shall not lapse but shall be\ncarried forward for the purposes of the fund until expended. Expenditures from the\nfund shall be made by the cabinet for the purposes of:\n(a) Payment of all expenses of the cabinet in processing Class VI permits and\ncertificate applications;\n(b) Regulating sequestration facilities during their construction, operation, and\npre-closure phases; and\n(c) Certifying the sequestration amount determinations under KRS 353.445.\n(2) The secretary may:\n(a) Enter into a cooperative agreement with another government agency to carry\nout regulatory responsibilities over a sequestration facility on behalf of the\nCommonwealth; and\n(b) Compensate the government agency for its expenses with money from the\nfund.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57871","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"f84d53e01f1b05097669f272be7293713b02a76371c5346eba5c17faf77e5ac0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.435","next":"us-ky/krs-353.439"},"notice":"GroundRules: Original legal text.
