{"data":{"id":"us-ky/krs-353.441","jurisdiction":"us-ky","citation":"KRS 353.441","heading":"Carbon dioxide sequestration facility trust fund.","body":"(1) There is hereby created in the State Treasury an interest -bearing, restricted, agency\naccount to be known as the carbon dioxide sequestration facility trust fund. Moneys\nin the fund shall be used for:\n(a) The long-term monitoring and management of sequestr ation facilities prior to\nclosure, plugging, and abandonment of all monitoring wells in the event of\noperator default;\n(b) Expenses associated with the long -term monitoring and management after\nissuance of a completion certificate; and\n(c) Determining the causes and remediating the effects of any releases or\nenvironmental emergencies associated with sequestration facilities.\n(2) All amounts required to be deposited into the fund shall not be segregated into\nseparate accounts but may be used by the cabinet a s provided in this section for any\ncarbon dioxide sequestration project. Notwithstanding KRS 45.229, any balance\nremaining in the fund at the end of any fiscal year shall not lapse but shall be\ncarried forward to carry out the purposes of the fund until fully expended.\n(3) The secretary may:\n(a) Enter into a cooperative agreement with another government agency to carry\nout regulatory responsibilities over a sequestration facility on behalf of the\nCommonwealth; and\n(b) Compensate the government agency for it s expenses with money from the\nfund.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57873","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"2d74a7d673c3d8a0ed447ebd7bc7cf4767026d510ee4f091bcf81a75338d02f2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.439","next":"us-ky/krs-353.443"},"notice":"GroundRules: Original legal text.
