{"data":{"id":"us-ky/krs-353.445","jurisdiction":"us-ky","citation":"KRS 353.445","heading":"Certification of injected carbon dioxide -- Fee.","body":"(1) The cabinet shall, upon request of an operator, certify the amount of injected carbon\ndioxide demonstrated to have been stored in a reservoir that has been or is being\nused for a Class II well in an enhanced oil or gas recovery project. Upon request of\nan operator, the cabinet may also certify the amount of injected carbon dioxide\nsequestered under KRS 353.411 to 353.459.\n(2) The amounts determined by the cabinet under subsection (1) of this section may be\nused for such matters as establishing the amounts o f carbon credits, allowances,\ntrading, emissions allocations, offsets, and for other similar purposes.\n(3) A person requesting a certification of a sequestration determination shall pay the\ncabinet a certification fee as authorized in KRS 353.459. The fee shall be calculated\nto ensure sufficient funds are available for the actual or anticipated cost to the\ncabinet to provide the certifications described in subsection (1) of this section.\n(4) Any fees the cabinet receives to provide the certifications descri bed in subsection\n(1) of this section shall be deposited into the carbon dioxide sequestration facility\nadministrative fund established in KRS 353.437.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57875","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"f481886548e7f30c45f4c8e8f0b03a2a28d9503e0047969f751db6a7b847baa3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.443","next":"us-ky/krs-353.447"},"notice":"GroundRules: Original legal text.
