{"data":{"id":"us-ky/krs-353.520","jurisdiction":"us-ky","citation":"KRS 353.520","heading":"Territorial application of KRS 353.500 to 353.720 -- Waste of oil and gas","body":"prohibited.\n(1) KRS 353.500 to 353.720 shall apply to all lands located in the Commonwealth,\nhowever owned, including any lands owned or administered by any government or\nany ag ency or political subdivision thereof, over which the Commonwealth has\njurisdiction under its police power.\n(2) The waste of oil and gas is hereby prohibited. The waste prohibited includes\nphysical waste as that term is generally understood in the oil and gas industry and\nincludes:\n(a) The locating, drilling, equipping, operating or producing of any oil or gas\nwell, or wells drilled, deepened, or reopened in a manner that causes, or tends\nto cause, a reduction in the quantity of oil or gas ultimately recoverable from a\npool under prudent and proper operations, or contrary to any provision of, or\nany order, rule or regulation promulgated or issued under KRS 353.500 to\n353.720;\n(b) Permitting the migration of oil, gas or water from the stratum in which it is\nfound into other strata, thereby ultimately resulting in the loss of recoverable\noil or gas, or both;\n(c) The drowning with water of any stratum or part thereof capable of producing\noil or gas in paying quantities, except for secondary recovery purposes, or  in\nhydraulic fracturing or other completion practices;\n(d) The unreasonable damage to underground, fresh or mineral water supply,\nworkable coal seams, or other mineral deposits in the operations for the\ndiscovery, development, production or handling of oil and gas;\n(e) The unnecessary or excessive loss of oil and gas by spillage or venting or\ndestruction of oil or gas or their constituents; and\n(f) The drilling of more wells than are reasonably required to recover efficiently\nthe maximum amount of oil and gas from a pool.\n(3) The production of oil or gas from any well in any pool unless a permit has been\nissued as required by KRS 353.500 to 353.720, or in violation of the spacing\nprovisions of KRS 353.500 to 353.720, is prohibited; except that this subsecti on\nshall not prohibit the continuation of production of oil or gas from a well producing\noil or gas on June 16, 1960.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33106","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"22740cac77db533d93060dea31d4553d8d98adb54f42532562aea1b2f25c2c02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.510","next":"us-ky/krs-353.530"},"notice":"GroundRules: Original legal text.
