{"data":{"id":"us-ky/krs-353.570","jurisdiction":"us-ky","citation":"KRS 353.570","heading":"Permit required -- Department may authorize operation prior to issuance","body":"of permit.\n(1) No person shall drill or deepen a well, drill a stratigraphic test well, or reopen a\nplugged well for the production of oil or gas or for the injection of water, gas or\nother fluid into any oil or gas producing formation (except seismograph test holes)\nafter June 16, 1960, or drill or deepen a water supply well after June 16, 1966, until\nsuch person shall obtain a permit from the department, except as provid ed in KRS\n353.588.\n(2) When any applicant for a permit as required by this section has complied with the\nprovisions of this chapter and all rules and regulations promulgated hereunder, the\ndepartment shall issue the permit.\n(3) The department may authorize  the commencement of the drilling, deepening or\nreopening of any well prior to the issuance of a permit therefor; except if the\nlocation of the well is known to be underlaid by a coal -bearing stratum and consent\nof the owner, operator, and lessee of the co al-bearing stratum has not been granted.\nConsent shall be implied, when the coal-bearing stratum is owned by the oil and gas\nlessor or lessee, and the coal is not under lease to any third party.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48625","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"07f6db8ae257e8c5bd3db9787e619eb82e9b270f2a2a60f3c1d88229488af5a3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.565","next":"us-ky/krs-353.572"},"notice":"GroundRules: Original legal text.
