{"data":{"id":"us-ky/krs-353.572","jurisdiction":"us-ky","citation":"KRS 353.572","heading":"Eligibility requirements for permit issuance or transfer under this chapter","body":"-- When operator ineligible to receive a permit or become a successor operator,\nfactors considered -- Energy and Environment Cabinet to promulgate\nadministrative regulations relating to compliance with eligibility requirements\n-- Restoration of eligibility for applicants, operators, and control persons.\n(1) The cabinet shall not issue a permit, or approve an application to transfer a well or\nwells to a successor operator  pursuant to KRS 353.590(23), and an operator shall\nnot be eligible to receive any permits or become a successor operator under this\nchapter, if:\n(a) The applicant has falsified or otherwise misrepresented any information on or\nrelating to the permit application;\n(b) The applicant has failed to abate or reach an agreement with the cabinet\nregarding an unappealed violation of KRS 353.500 to 353.720 or the\nadministrative regulations promulgated thereunder;\n(c) A control person of the applicant has a forfeiture of a bond;\n(d) The applicant is a control person for another operator that has a forfeiture of a\nbond;\n(e) A control person for the applicant served as a control person for another\noperator when an unresolved bond forfeiture occurred; or\n(f) The applican t is or has a control person who controls or is controlled by\nanother operator that has a forfeiture of a bond.\n(2) The cabinet may promulgate administrative regulations to allow for the proper\nadministration of the compliance review described in this sect ion. The cabinet shall\nrestore eligibility for applicants, operators, and control persons who are deemed\npermit-ineligible pursuant to subsection (1)(a) of this section upon the resubmission\nof the application correcting the false or misrepresented informa tion. The cabinet\nshall restore eligibility for applicants, operators, or control persons who are deemed\npermit-ineligible pursuant to subsection (1)(b) of this section upon satisfactory\nabatement of the violation, including payment of any civil penalties.  The cabinet\nshall restore eligibility for applicants, operators, or control persons who are deemed\npermit-ineligible pursuant to subsection (1)(c) to (f) of this section upon entry and\nsatisfactory compliance of an agreed order between the operator and the cabinet that\nresolves all of the operator's outstanding violations, requires payment of any civil\npenalties, and provides restitution to the cabinet for any costs associated with the\nforfeiture, plugging, and proper abandonment of a well in excess of the  bonded\namount.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48623","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"9ff7ef4bb9b0cbf356edea9ec5cc8b30550a52ba0e535df5f34f87402cd070e4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.570","next":"us-ky/krs-353.575"},"notice":"GroundRules: Original legal text.
