{"data":{"id":"us-ky/krs-353.580","jurisdiction":"us-ky","citation":"KRS 353.580","heading":"Expiration of permit -- Extensions.","body":"(1) Each permit issued under KRS 353.500 to 353.720 shall expire one (1) year after\nthe date issued, unless the drilling, deepening, or reopening of a well is commenced\npursuant thereto prior to the expiration of the one (1) year period. However, the\npermit te rm shall be extended by one (1) year if, prior to the expiration date, the\npermit applicant notifies the department in writing of the applicant's request for an\nextension, notifies the owner, record coal lessee, or mine licensee originally entitled\nto receive a copy of the plat under KRS 353.050, submits an affidavit stating that\nthe information in the original permit application is still correct, and submits a fee\nfor the extension in an amount equal to the permit fee required by KRS 353.590.\nWith respect to permits issued prior to July 15, 2002, no extension shall be granted\nfor any permit in cases where there has been a complete severance of the ownership\nof the oil and gas from the ownership of the surface to be disturbed, unless the\nrequested extension is agreed to in writing by the surface owner.\n(2) The extension of the permit term pursuant to subsection (1) of this section shall not\ncreate a right to object to the well location under KRS 353.060 nor to mediation\nunder KRS 353.5901.\n(3) All permits iss ued by the department under any previous statute shall continue in\nforce as written, only if the drilling of the well has been commenced pursuant\nthereto on or before sixty (60) days after June 16, 1960.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=33114","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:39Z","sha256":"74768b320d0bb4d610de584bd46e9371f9fadb4284190363e0a34a93eb2e5b76","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.575","next":"us-ky/krs-353.588"},"notice":"GroundRules: Original legal text.
