{"data":{"id":"us-ky/krs-353.620","jurisdiction":"us-ky","citation":"KRS 353.620","heading":"Variance from requirements of KRS 353.610 -- Review under KRS","body":"353.700.\n(1) Notwithstanding KRS 353.610, if an application is submitted for a permit to drill,\ndeepen, or reopen a well closer to a boundary or to another well than prescribed in\nKRS 353.610 and the application is accompanied by the written consent of all\nowners o f oil and gas interests within the distance prescribed in KRS 353.610,\nwhich will be offset by the proposed well, the department shall issue a permit for\nthe well.\n(2) Notwithstanding KRS 353.610, if an application is submitted for a permit to drill,\ndeepen, or reopen a well closer to a boundary or to another well than prescribed in\nKRS 353.610, and the director determines after notice to all owners of oil and gas\ninterests within the distance prescribed in KRS 353.610 that topographical or other\nfactors delineated by subsurface geologic mapping or reservoir analytical data make\ncompliance with the requirements of KRS 353.610 unduly burdensome, or in\nconflict with reasonably prudent methods and practices for the production of oil or\ngas, the department may i ssue a permit for the well. The application may include\nbut not be limited to core analysis, geophysical or electric log data, reservoir\npressure analysis, or other information demonstrating to the satisfaction of the\ndirector that such relief is warranted.\n(3) Notwithstanding KRS 353.610, the department shall issue a permit for a well to be\ndrilled, deepened, or reopened closer to a boundary than prescribed in KRS 353.610\nif a pooling order has been issued pursuant to KRS 353.630.\n(4) If a permit is issued  to drill, deepen, or reopen a well under subsection (1) or (2) of\nthis section at a location closer to a well or boundary than prescribed in KRS\n353.610, the department shall permit a like variance from the requirements of KRS\n353.610 on all premises offset and adversely affected by the well.\n(5) Any order or final determination of the department under this section shall be\nsubject to review in accordance with KRS 353.700 and any administrative\nregulations promulgated thereunder.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47761","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:40Z","sha256":"43b1d8dff9b48e7eb45ec92aa9a5e8dc8210c1cb6662825deb6940d2ba69b39b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.610","next":"us-ky/krs-353.630"},"notice":"GroundRules: Original legal text.
