{"data":{"id":"us-ky/krs-353.6601","jurisdiction":"us-ky","citation":"KRS 353.6601","heading":"Advance notice to surface owner located within 1,000 feet of high -volume","body":"horizontal fracturing treatment of a horizontal well.\n(1) An operator employing a high -volume horizontal fracturing treatment shall provide\nnotice required under subsection (3) of t his section to each surface property owner\nwithin one thousand (1,000) feet of the surface location of the proposed well, at\nleast twenty (20) days prior to commencement of a high -volume horizontal\nfracturing treatment of a horizontal well. For purposes of  this subsection, a surface\nproperty owner is the person who is assessed for the purpose of taxes imposed\naccording to the records of the property valuation administrator of the county where\nthe property is located.\n(2) The operator shall, for the purpose of giving notice, secure from the property\nvaluation administrator's office the names of persons entitled to notice under this\nsection. Notice to the persons indicated as surface property owners in the office of\nthe property valuation administrator shall b e conclusive evidence that the operator\nhas met the requirements of this section.\n(3) The notice to surface property owners shall include:\n(a) The name and address of the operator;\n(b) The surface location of the proposed well; and\n(c) The name and locatio n of the cabinet office where the permit and related\ndocuments are available for public inspection and, if the documents are\navailable electronically, the Web site where the permit and related documents\nmay be inspected.","path":["KRS Chapter 353"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44244","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:40Z","sha256":"9485347465d1be7b7fee037029fa1261c5ef0b1097e5d887babe69449c7a3504","source_id":"us-ky","stale":false,"prev":"us-ky/krs-353.660","next":"us-ky/krs-353.6602"},"notice":"GroundRules: Original legal text.
